You must cooperate with us to locate the non-custodial parent, establish paternity, establish and enforce a child support order. |
You may claim "good cause" for not cooperating with us if you fear for the safety of you or your child.
You assign your rights to receive child support to the state to pay back the cash assistance you and your child get. This means any support paid on your or your child’s behalf must be sent to the state. You must send any payments for child support received directly from the other parent to the state. |
You may be eligible to receive a payment called a “pass through” payment in addition to the Families First cash payment. The amount of the “pass through” payment depends on the amount of child support collected for that month. Ask your Families First case manager if you are eligible. |
Families who stop receiving Families First will keep receiving child support services unless they ask that child support services be stopped. If there is court-ordered child support that was not paid during the period Families First benefits were received, we will try to collect the unpaid child support even if you close your case. |
Your case and court order will be reviewed every three years to see if the amount of child support needs to be changed or if health insurance needs to be ordered. |
Anyone who needs child support services, regardless of income, may apply for our services free of charge. However, there may be charges for court filing fees or other court costs. |
Please let us know if you or your children have ever received Families First (or AFDC) or TennCare/Medicaid benefits. |
We provide the same child support services and treatment to both Families First recipients and to customers who are not receiving Families First benefits. |
Families who stop receiving Families First will keep receiving child support services unless they request that these services stop. We will keep trying to collect unpaid child support for the period that you received Families First benefits even if you close your case. We will normally send any money that we do collect to the state. |
We need you to cooperate with us. If you don’t, we may close your case. |
We need to know if your children leave your custody. |
Let us know if you have hired a private attorney and about any court action taken. |
When you sign the application for services, you are declaring that you understand:
The child support attorney represents the state and not you as an individual. |
Petitions are based on information that you provide and are filed for the purpose of enforcing a legal obligation and not for harassment. |
We do not guarantee success of any action or results within any specific time frame. |
Our services are limited to child support and do not include issues such as custody and visitation. You need to hire a private attorney to deal with these issues. |
We can provide services to anyone in the state, and so there may be other parents in the program whose interests are opposed to your own. |
We may submit your case to the Federal Treasury Offset Program, to intercept income tax refunds from the non-custodial parent. We cannot guarantee that money will be collected. |
You have the right to request a review of your child support order to see if the amount of child support needs to be changed (if there has been a change of 15% or more in the income of the non-custodial parent) or if health insurance needs to be added.
